H.R.1424 - Paul Wellstone Mental Health and Addiction Equity Act of 2007 Amends the Employee Retirement Income Security Act of 1974 (ERISA), the Public Health Service Act, and the Internal Revenue Code to prohibit treatment limits or the imposition of financial requirements on mental health and substance-related disorder benefits in group health plans which are not similarly imposed on substantially all medical and surgical benefits in any category of items or services under such plans. UPDATE: 10/10/07 passed from sub-committee to full committee. TAKE ACTION: If your Congressman isn’t listed as a co-sponsor, contact them and ask them to sign on in support of the bill. H.R. 3195 - ADA Restoration Act of 2007 Amends the Americans with Disabilities Act of 1990 to restore the intent and protections of that Act. On October 4th, the House Judiciary Subcommittee on the Constitution, Civil Rights, and Civil Liberties held a hearing, sponsored by House Majority Leader Steny Hoyer (D-MD), Representative James Sensenbrenner (R-WI), and more than 220 of their colleagues. H.R. 2895 - The National Affordable Housing Trust Fund Act of 2007 The bill would establish a national affordable housing trust fund. At least 75% of the new resources must produce or preserve housing affordable to extremely low income people. This would be the first new housing production program since 1990 and the only one focused on housing for households with the lowest incomes. This is also the first time a bill establishing a National Housing Trust Fund will be considered on the floor of Congress! UPDATE: On October 10th, the full House of Representatives voted to pass the bill. It now goes to the Senate. Court Ruling Says California Disabled Rights Law Applies to the Web Source: National Federation for the Blind A federal district court judge issued two landmark decisions in a nationwide class action against Target Corporation. First, the court certified the case as a class action on behalf of blind Internet users throughout the country under the Americans with Disabilities Act (ADA). Second, the court held that Web sites such as target.com are required by California law to be accessible.

Much to be Thankful for, but Much More Left Undone! By Phil Pangrazio, ABIL Executive Director
As we approach the Thanksgiving Holiday, we have many things for which to be thankful. The Diamondbacks won the national league west, the Cardinals started the season with 3 wins and only 2 losses, and Phoenix temperatures are finally below 110 degrees.
We at ABIL have much to be thankful for too!
* Construction of the Disability Empowerment Center facility is nearly fifty percent complete and is on schedule for a July 1, 2008 opening.
* We’ve received contractual commitments from several of our future tenant partners that include Arizona Center for Disability Law, Raising Special Kids, Arizona Multiple Sclerosis Society, Statewide Independent Living Counsel, Joni & Friends, and GALA Human Services Cooperative.
* We’ve received an additional $1.6 million in capital support for construction of the Sports & Fitness Center (i.e. $1 million from Virginia G. Piper Charitable Trust, $500,000 from the David Reese Family Foundation, $100,000 from the Phoenix Thunderbirds Charities, plus $60,000 of program funding from the Rhett Butler Family Foundation, this to go along with the $5.3 million in City of Phoenix bond funds that were already secured).
* We successfully relocated and opened our new west valley office at 75th Avenue and Indian School road.
* We are partnering with AHCCCS to implement the AZ Health and Disability Partnership through a Medicaid Infrastructure Grant that will provide peer-to-peer training and education for physicians and include a marketing campaign that is designed to reach SSDI beneficiaries and others with disabilities to improve return to work outcomes for people with disabilities.
With all that we have to be thankful for, however, there are still many areas of disability policy that fall woefully short in terms of equality and access to services. The unemployment rate of people with disabilities still remains at about 70 percent. In addition, the majority of states (fortunately not Arizona) continue to struggle with an “institutional bias” against persons with physical disabilities/aged (regardless of age) that directs on-average 71.4 percent of all Medicaid long-term-care funding to nursing facility institutional services and only 28.6 percent on community-based services such as personal care, attendant care and other home health services. In dollars, nursing homes received $47.7 billion to institutionalize persons with physical disabilities/aged versus only $19.2 billion that was spent for community-based services (data was computed from the FY 2006 Centers for Medicare & Medicaid Services MA reports).
Two federal initiatives could improve these poor outcomes. First, the Community Choice Act of 2007 (S.799 & H.R. 1621) addresses provisions that would provide a range of community-based supports that would include activities of daily living such as eating, toileting, grooming, dressing, bathing and transferring; and could include meal planning, shopping and preparation, financial management, and household chores.
Second, is the “Amendments to the Ticket to Work and Self Sufficiency Program” that were published by SSA on September 30th, 2005 and are rumored for implementation in early 2008. The proposed regulations address critical deterrents to the participation of Employment Networks (ENs) in the Ticket Program.
We need to communicate to the President and Congress that people with disabilities have a right to live in the community and that we have waited long enough for the release of the final Ticket regulations that would improve opportunities for people with disabilities to achieve economic self-sufficiency through work. …………………………………………

NEWS RELEASE: The Medicare Bus is Coming to Scottsdale & Sun City Thursday, November 15th! The Department of Health and Human Services (HHS) and the Centers for Medicare & Medicaid Services (CMS) will join with local partners at two events in the Phoenix area to provide information about the tools and resources that are available to help people with Medicare during Medicare’s Fall Annual Enrollment, which runs November 15-December 31, 2007. During Annual Enrollment, people with Medicare will be selecting Medicare health and drug coverage for 2008.
People with Medicare are urged to assess their health needs, review their current health and drug coverage, compare it with other area plans, and choose a plan that’s best for them. They are also urged to act quickly, so their coverage works smoothly in 2008. Extra help is available for people with Medicare who cannot afford their prescription drug costs. Counselors will be available to assist you, caregivers and family members in reviewing your options with Medicare health and prescription drug plans. Experts will also be on-site and ready to help eligible people with Medicare learn more about the $3,600 that is available to help pay for their drug coverage and to help them complete the extra help applications.

Urgent! “Extra Help” for Medicare Part DIf you have received help from Social Security (SSA) to cover your Medicare Part D expenses because of your low income, then you need to know the following information. Many beneficiaries recently received, or soon will receive, a form that they need to complete to recertify that they are eligible for Extra Help. Extra Help is the subsidy that beneficiaries with low income and limited resources receive to help them pay Medicare Part D deductible and co-pay amounts.
This year is the first time that the forms MUST BE FILLED OUT AND RETURNED in order for beneficiaries to continue their eligibility. Forms must be sent back to the SSA in the envelope provided, or eligibility may be lost for Extra Help effective January 1, 2008.
If you are a beneficiary who gets a letter about the re-certification, please complete and return the form as soon as possible! The forms must be returned within 30 days after the beneficiary receives it. If you are waiting for information from another agency or need assistance, you may call Social Security toll-free at 1-800-772-1213 (TTY 1-800-325-0778). If you do need assistance, SSA can give you an additional 30 days to return the forms. ………………………………
City of Surprise Issues “Person First Language” Proclamation
The City of Surprise is home to only about 100,000 residents yet is one of the first cities to issue a “Person First Language” Proclamation. “Person First Language” refers to language that is respectful and promotes dignity. It places a person ahead of a disability he or she might experience. For example, instead of referring to your “disabled neighbor,” you might refer to your “neighbor with a disability.” Consider though whether you even need to refer to the person’s disability. You might think it odd if I tell a story and mention my “blonde daughter,” my “short friend,” etc. So ask yourself, does a person’s disability need to be mentioned? If it’s in the context of services or activities that may require an accommodation - yes, if not - no.
The City of Surprise has an active Disability Advisory Commission that meets the third Wednesday of each month in the City Hall Council Chambers. The Commission focuses on community-wide accessibility that addresses the needs of people with disabilities while increasing public awareness and advocacy. AZ Freedom to Work, Work Incentives Planning & Assistance Q&A By Erik Jensen Q: I’m in high school and receive SSI. I have an opportunity to study abroad in a student exchange program, but I don’t want my benefits to stop. Is this even possible?
A: YES, provided the program meets certain criteria. To continue to receive SSI while studying abroad, make sure that: o The international exchange course of study is not available to you in the U.S. o The study abroad program is sponsored by a school in the U.S. o Participation is critical to your educational and vocational success. o You are eligible for SSI for the one month immediately prior to leaving the U.S. o You will earn academic credits towards your high school diploma or college degree while abroad.
If you receive SSI payments and plan to study abroad for up to one year, you can work with a Community Work Incentives Coordinator to arrange to continue your SSI payments while you are abroad.
